Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the PermianIQ platform at permianiq.com (the “Service”), operated by PermianIQ LLC (“we,” “us,” or “PermianIQ”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Service Description
PermianIQ provides a web-based platform for searching, viewing, and analyzing publicly available data related to saltwater disposal (SWD) wells, injection volumes, seismic events, and seismic response areas in the Permian Basin of Texas. The data is derived from public regulatory sources including the Texas Railroad Commission, the Bureau of Economic Geology TexNet Seismic Monitoring Program, and the U.S. Geological Survey.
The Service is a data presentation and analysis tool. It is not engineering, geological, environmental, or legal advice. PermianIQ does not provide well operations guidance, disposal recommendations, or regulatory compliance services.
3. Accounts
You must create an account to access well detail views. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans and Payment
Free tier: Unlimited map browsing and up to 3 detailed well views. No CSV export.
Pro ($49/month or $399/year): Unlimited well detail views, CSV export, and saved searches.
Teams ($149/month): Everything in Pro plus API access, automated alerts, capacity forecasting, and area reports. Available by contacting us.
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. You may cancel at any time through the Stripe Customer Portal; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
We reserve the right to change pricing with 30 days’ notice. Price changes do not affect active subscriptions until the next renewal.
5. Data Accuracy and Disclaimers
All data presented through the Service is derived from publicly available government data sources. While we make reasonable efforts to ensure accuracy, completeness, and timeliness:
- Data accuracy, completeness, and timeliness are not guaranteed. Government source data may contain errors, omissions, or reporting delays.
- Derived metrics are estimates. Capacity utilization percentages, risk indicators, and other calculated values are derived from reported data and permitted rates. They do not account for subsurface conditions, equipment limitations, regulatory restrictions not reflected in public records, or other factors.
- Operator names may be outdated. Operator names change due to mergers, acquisitions, and corporate reorganizations. We update operator data periodically but cannot guarantee real-time accuracy.
- Seismic Response Area boundaries may change. The Texas Railroad Commission may issue new SRA orders or modify existing boundaries at any time. Our data reflects the most recently published boundaries at the time of our last update.
You are responsible for independently verifying all data before making operational, financial, investment, or regulatory decisions. The Service is not a substitute for direct verification with the Texas Railroad Commission, the Bureau of Economic Geology, or any other regulatory body.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or bulk-download data from the Service through automated means
- Resell or redistribute Service data as a competing data product
- Interfere with the operation of the Service or other users’ access
- Misrepresent data from the Service as engineering analysis, regulatory compliance documentation, or professional advice
7. Intellectual Property
The underlying government data presented through the Service is public and not subject to copyright (consistent with Feist Publications, Inc. v. Rural Telephone Service Co.). However, the PermianIQ platform — including its software, design, user interface, derived calculations, and original content — is owned by PermianIQ LLC and protected by applicable intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMIANIQ LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR OPERATIONAL DECISIONS MADE BASED ON SERVICE DATA.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PERMIANIQ IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Indemnification
You agree to indemnify and hold harmless PermianIQ LLC from any claims, losses, or damages (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your reliance on data obtained through the Service for operational or financial decisions.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
12. Governing Law
These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Texas.
13. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
